The question posed in this article is whether Catholics can fully, unreservedly, and conscientiously carry out their duties as citizens and as holders of their various public offices (legislative, judicial and executive) of the State, in accordance with the laws and constitution of the democratic and pluralist States in which they live. My concern—as a practicing Catholic and a practicing lawyer—is that the increasingly fierce Church criticism, which arose during the papacy of John Paul II and now of Benedict XVI, (...) of the perceived trend towards secularization in the social and political mores of Western (particularly European) democracies, and the greater readiness by Church officials to take it upon themselves explicitly to instruct the laity in political matters, puts this whole issue again into question. Should the bishops of the Catholic Church be seeking to use their ecclesiastical authority (over the faithful) to oppose or promote changes in the laws which apply to all within our society and/or to influence the way we might vote or carry out civic duties? This is a big and complex area involving the interplay of politics and theology; of private and public morality. It touches on the role of teaching office of the Catholic Church and the assent (and possibility of dissent) on the part of the faithful. It takes in questions of conscientious objection and unjust laws. It concerns individual conscience and the hope of salvation. It is about voting as sinning. It is about judging, and being judged. Resumo Uma das reivindicações centrais dos movimentos políticos islâmicos é cumprir ou impor a sharī'a . Mas a visão que esses movimentos têm destoa da maneira como os sistemas jurídicos muçulmanos funcionaram historicamente. A própria definição de sharī'a , sua relação com o poder político, e sua aplicação num processo que leva a uma decisão jurídica, foram simplificados durante o processo de codificação dos séculos XIX e XX, e os movimentos islamistas são herdeiros dessa concepção "ocidentalizada" de sharī'a. Frequentemente traduzido (...) com "lei religiosa" ou "direito islâmico" o termo sharī'a não corresponde ao conceito ocidental de "lei" nem tampouco engloba todo o campo do direito dos povos muçulmanos. Paralelamente à sharī'a , também há o qānūn (o direito do soberano), e as regras derivadas do costume ( 'urf , adalat ). O objetivo deste artigo é analisar a formação da dualidade entre sharī'a e qānūn no direito muçulmano até a codificação da sharī'a no século XX e a dissolução dessa dualidade nas ideologias islamistas contemporâneas. Palavras-chave: sharī'a; islamismo; direito muçulmano. One of the main claims of contemporary Islamic political movements is to implement the sharia. But the view of the sharia held by those movements diverges from the Muslim judicial systems as they actually functioned throughout history. The very definition of sharia, its relation with the political power, and its implementation in specific cases, were simplified during the process of codification that took place between the 19 th and 20 th centuries, and contemporary Islamic movements inherited this "westernized" conception of sharia. Though often translated as "Islamic law", the term does not correspond exactly to the Western concept of "law", and neither does it comprise the whole field of law among Muslim peoples. Parallel to the sharia, there is also the qānūn (the law of the ruler), and the rules derived from costume ( 'urf, adalat ). This article intends to analyze the formation of the duality between sharia and qānūn in Islamic law until the codification of the sharia in the 20 th century, and the dissolution of this duality in contemporary Islamist ideologies. O Fasl al-maqal, umas das obras originais de Averróis, se destaca por seu caráter polêmico. Sendo redigida como um pronunciamento jurídico, tem como um de seus objetivos principais analisar o estatuto da filosofia em face da Lei islâmica, ao verificar qual é a atitude que deve ser adotada por todo aquele que travar contato com as obras da antiguidade grega. Em um cenário em que a legitimidade da filosofia se coloca em questão, o diagnóstico e a solução propostos por Averróis (...) se destacam ao apresentar uma interpretação singular da Lei ante a filosofia, concebendo a segunda como um elemento necessário para a saúde da comunidade. Este artigo pretende analisar essa interpretação, na qual três pontos se colocam na consideração da relação entre filosofia e revelação: o (1) asseguramento da possibilidade do assentimento religioso individual e (2) da manutenção do bem-estar geral junto à (3) possibilidade de se afirmar a legitimidade de um intérprete que garanta o assentimento correto aos crentes não filósofos. The eukaryote cell is one of the most radical innovations in the history of life, and the circumstances of its emergence are still deeply contested. This paper will outline the recent history of attempts to reveal these origins, with special attention to the argumentative strategies used to support claims about the first eukaryote cell. I will focus on two general models of eukaryogenesis: the phagotrophy model and the syntrophy model. As their labels indicate, they are based on claims about metabolic (...) relationships. The first foregrounds the ability to consume other organisms; the second the ability to enter into symbiotic metabolic arrangements. More importantly, however, the first model argues for the autogenous or self-generated origins of the eukaryote cell, and the second for its exogenous or externally generated origins. Framing cell evolution this way leads each model to assert different priorities in regard to cell-biological versus molecular evidence, cellular versus environmental influences, plausibility versus evolutionary probability, and irreducibility versus the continuity of cell types. My examination of these issues will conclude with broader reflections on the implications of eukaryogenesis studies for a philosophical understanding of scientific contestation. (shrink)

In The Idea of Prison Abolition, Tommie Shelby evaluates arguments for and against the elimination of incarceration as a mode of punishment. In this article, we discuss and expand upon Shelby's arguments, using two very different systems—those of Norway and the United States—as examples to illustrate some general principles.

Among the various methods of deceit, lying is often thought to be a special affront on the grounds that it invites the victim’s trust. Such an explanation is incomplete without an account of the moral significance of trust. This article distinguishes two morally problematic relations to trust, betrayals and abuses, and, appealing to the idea that we should be grateful to be trusted, attempts to explain these wrongs as violations of distinct demands of gratitude for trust. Only the wrong of (...) abuse, not betrayal, is useful for distinguishing methods of deceit. Although lying commits an abuse of trust, it turns out that it is really the broader category of deceit by means of communication that is special in this way. -/- . (shrink)

If the density matrix is treated as an objective description of individual systems, it may become possible to attribute the same objective significance to statistical mechanical properties, such as entropy or temperature, as to properties such as mass or energy. It is shown that the de Broglie--Bohm interpretation of quantum theory can be consistently applied to density matrices as a description of individual systems. The resultant trajectories are examined for the case of the delayed choice interferometer, for which Bell [Int. (...) J. Quantum chem. 155--159, (1980)] appears to suggest that such an interpretation is not possible. Bell’s argument is shown to be based upon a different understanding of the density matrix to that proposed here. (shrink)

Abstract: The systemic role of corruption and its link to low human development is explored. The extractive resource industry is presented as an arena where conditions for corruption—monopoly and discretion without accountability—are especially intense. Corruption is maintained by a self-reinforcing cycle. Multiple stakeholders are involved in the maintenance of and/or opposition to the cycle: investing corporations, host country regimes and officials, inter-governmental bodies like the OECD, industry associations, non-governmental organization (NGO) watchdogs like Transparency International, and international agencies facilitating global investment (...) like the World Bank. Complementarity of interests between the demand and supply sides provides strong incentives for entrenched players to maintain corruptive relationships, to protect past gains and sustain current ones. Compulsory international regulation, maximum transparency, effective detection, and enforcement are recommended to enhance accountability, thereby reversing the cycle. It is also necessary to create a corporate culture built on integrity, if regulation itself is to succeed. (shrink)

Мета. У сучасному глобальному суспільстві під питанням виявилися традиційні цінності, у тому числі патріотизм і героїзм. Однак нові виклики гібридної війни потребують нових виявів героїзму, а отже, і його нового філософського осмислення. Основною метою цієї статті є філософсько-антропологічне осмислення героїзму як граничного вияву сили духу, що поєднує інституційні засади суспільного блага та індивідуальну волю до його досягнення. Теоретичний базис. Феномен героїзму досліджено в класичних працях Гомера, Плутарха, Томаса Карлайла. Важливі сучасні філософсько-антропологічні інтерпретації цього феномену надають Фрідріх Ніцше, Гельмут Плеснер та (...) Альбер Камю, згідно з якими героєм може стати кожна людина за умови виявлення нею сили духу та незламного прагнення до боротьби і перемоги. Феномен героїзму тому набуває масовості і, хоча ніколи не може бути тотальним у суспільстві, однак може стати предметом виховання і самовиховання. Наукова новизна. Сила духу воїна відображена в його повсякденній стійкості (resilience), яка не має гендерної визначеності. Її яскраві втілення в сучасному суспільстві можна простежити на прикладі героїзму, самовідданості й наполегливості воїна в умовах гібридної війни. Ці нові втілення не лише підтверджують сталі філософсько-антропологічні уявлення про героїзм, але й надають йому нових рис. Висновки. Сучасне переосмислення героїзму на прикладі граничного вияву сили духу в умовах гібридної війни дало можливість уточнити його філософсько-антропологічну концепцію. Зразкова непохитність і послідовність у виявленні демократичних цінностей у вкрай несприятливих для цього обставинах робить сучасними героями не лише професійних військових, але й усіх громадян, які демонструють свої найкращі соціальні чесноти в захисті соціальних інститутів демократії. Сучасна гібридна війна створює фронтир героїчного протистояння тоталітаризму в глобальному масштабі. Сучасний герой постає як взірцевий громадянин своєї національної держави і водночас демонструє чесноти справжнього представника світового громадянського суспільства. (shrink)

This paper brings a fresh, epistemic perspective to bear on prominent Confucian philosophers’ arguments for a hybrid Deweyan-Confucian democracy, or for an illiberal democracy with “Confucian characteristics.” Reconstructing principles for epistemic elitism and paternalism from the pre-Qin 秦 Confucian thought that inspires these advocates for Confucian democracy, it finds two major problems with their proposals. For those who abandon or modify this epistemic elitism and paternalism in accordance with , the result is a philosophical syncretism that is either unconvincingly Confucian (...) or unconvincingly Deweyan. For those who retain it in accordance with , the result is a democratic proposal that will lack legitimacy in increasingly pluralistic East Asian societies. In the end, there is a need for thinking that appropriately synthesizes Eastern and Western philosophies in a politically changing East Asia, but it would benefit from being less “Confucian.”. In this paper, the theory and practice of therapeutic touch (TT) is scrutinized from a number of perspectives. Firstly, the alleged close relationship between TT and Martha Rogers’ Science of Unitary Human Beings is evaluated. Secondly, the employment of the language of modern physics in Rogers’ theory and TT is critically examined. The authors then review the research literature on TT's efficacy, completing their critique by discussing the ethical issues involved in the practice of TT. As each of the perspectives (...) considered reveals some concerns, the paper concludes that TT is a questionable intervention, underpinned by a very weak theoretical, clinical and research base. Mental health, in one awake, guarantees that person knowledge of the central phenomenon-contents of his own mind, under an adequate classificatory heading. This is the primary thesis of the paper. That knowledge is not itself a phenomenon-content, and usually is achieved in no way. Rather, it stems from the natural accessibility of mental phenomenon-contents to wakeful consciousness. More precisely, when mental normality obtains, such knowledge necessarily obtains in wakeful consciousness. This thesis conjoins a version of Cartesianism with the concepts of (...) mental health and human nature. Demonstration of the thesis requires that we show that a particular human mental potential fails fully to be realized when such self-awareness is impaired. That potential is for consciousness of the world (w-Cs), wakefulness. W-Cs divides into consciousness of the outer world (ow-Cs), and consciousness of the inner world (iw-Cs), and we need to demonstrate an essential dependence of ow-Cs upon iw-Cs. Now w-Cs is the adoption of the correct occurrent epistemological posture to the world, and this involves free rational determination of occurrent cognitive attitudes via the internal systematized knowledge of the world, which requires adequate awareness of mental phenomenon-contents. Therefore ow-Cs needs iw-Cs. This is displayed in mental structural accounts of hypnotic, drunken, and psychotic disturbances of consciousness. (For we endorse a structural account of mental health.) We show how failures of self-consciousness entail disturbed modes of determination of cognitive attitudes by the knowledge-system, which is loss of contact with the personal yet true internal representation of the world, which is loss of contact with reality, which is a disturbance both of w-Cs and of consciousness itself. In this paper I advance a constitutive argument for the authority of rational norms. Because accountability to reasons is constitutive of rational agency and rational norms are implicit in reasons for action and belief, the justification of rational norms is of a piece with the practice of reasoning. Peter Railton has objected that the constitutive view fails to defend the categorical authority of reason over agents. I respond to his objections, arguing that they presuppose a foundationalist conception of justification that (...) demands a ground for reason's authority outside of the practice of reasoning. Fines and monetary damages account for the majority of legal sanctions across the whole spectrum of legal governance. Money is, in key respects, the primary tool law has to achieve compliance. Yet money has largely been ignored by social analyses of law, and especially by social theory. _The Currency of Justice_ examines the differing rationalities, aims and assumptions built into money’s deployment in diverse legal fields and sanctions. This raises major questions about the extent to which money appears as an (...) abstract universal or whether it takes on more particular meanings when deployed in various areas of law. Indeed, money may be unique in that it can take on the meanings of punishment, compensation, denunciation or regulation. _The Currency of Justice_ examines the implications of the ‘monetization of justice’ as life is increasingly regulated through this single medium. Money not only links diverse domains of law; it also links legal sanctions to other monetary techniques which govern everyday life. Like these, the concern with monetary sanctions is not who pays, but that money is paid. Money is perhaps the only form of legal sanction where the burden need not be borne by the wrongdoer. In this respect, this book explores the view that contemporary governance is less concerned with disciplining individuals and more concerned with regulating distributions and flows of behaviours and the harms and costs linked with these. It suggests that both scepticism and Cartesianism provided new arguments to establish the equal capabilities and entitlements of women and men. In this debate, traditional metaphysics was seen once again to support prejudices rather than evidence-based arguments. The Implicit Association Test (IAT) was used to measure population levels of conceptual alignment among two polar sensory metaphors and clusters of concepts to which they are commonly applied. A total of 873 participants were tested online, to compare within- and between-cluster alignments of concepts associated with two different polar sensory metaphors (up/down and black/white). IAT results were sensitive to semantic alignments that were also picked up by Latent Semantic Analysis (LSA) using a large-scale corpus of English. However, even with (...) these semantic alignments taken into account, the dual categorization results demonstrated strong metaphor-cluster alignments over and above the predictions of LSA. It is proposed that, rather than ontogenetic development of metaphoric concepts based on sensorimotor experience, conventionalized sensorimotor metaphors in language may be cognitive tools that provide language learners with insights supported by conceptual properties of a phylogenetically evolved perceptual interface. Intimate partner violence is an important problem that has significant detrimental effects on the wellbeing of female victims. The chronic physical and psychological effects of intimate partner violence are complex, long-lasting, chronic, and require treatments focusing on improving mental health issues, safety, and support. Various psycho-social intervention programs are being implemented to improve survivor wellbeing. However, little is known about the effectiveness of different treatments on IPV survivors' wellbeing. For this purpose, we conducted a systematic review and meta-analysis to assess (...) the effectiveness of interventions on improving outcomes that describe the wellbeing of adult female survivors of IPV. We searched PubMed, PsycINFO, and Cochrane Library. We explored the effectiveness of available interventions on multiple outcomes that are critical for the wellbeing of adult female victims of IPV. To provide a broad and comprehensive view of survivors' wellbeing, we considered outcomes including mental health, physical health, diminishing further violence, social support, safety, self-efficacy, and quality of life. We reviewed 2,770 citations. Among these 25 randomized-controlled-study with a total of 4,683 participants met inclusion criteria. Findings of meta-analyses on interventions indicated promising results in improving anxiety [standardized mean difference −7.15, 95% confidence interval −8.39 to −5.92], depression, safety, violence prevention, health, self-esteem, social support, and stress management at the post-test. We found that empowerment plays a vital role, especially when treating depression and Post-Traumatic Stress Disorder, which are difficult to improve across interventions. We found mixed findings on self-efficacy and quality of life. The effects of IPV are long-lasting and require treatments targeting co-morbid issues including improving safety and mental health issues. (shrink)

New light is shed on Leibniz’s commitment to the metaphysical priority of the intensional interpretation of logic by considering the arithmetical and graphical representations of syllogistic inference that Leibniz studied. Crucial to understanding this connection is the idea that concepts can be intensionally represented in terms of properties of geometric extension, though significantly not the simple geometric property of part-whole inclusion. I go on to provide an explanation for how Leibniz could maintain the metaphysical priority of the intensional interpretation while (...) holding that logically the intensional and the extensional stand in strictly inverse relation to each other. By claiming that “just war is just war,” critics suggest that just war theory both distracts from and sanitizes the horror of modern warfare by dressing it up in the language of moral principles. However, the phrase can also be taken as a reminder of why we need just war theory in the first place. It is precisely because just war is just war, with all that this implies, that we must think so carefully and so judiciously about it. Of (...) course, one could argue that the rump of just war scholarship over the past decade has been characterized by disinterest regarding the material realities of warfare. But is this still the case? This essay examines a series of benchmark books on the ethics of war published over the past year. All three exemplify an effort to grapple with the hard facts of modern violent conflict, and they all skillfully bring diverse traditions of just war thinking into conversation with one another.
